Welcome to NexGen Auto Transport LLC (“NexGen,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of nexgenautotransport.com and the vehicle shipping services we arrange. By using our website, requesting a quote, or booking a shipment, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Our Services

NexGen Auto Transport LLC is a licensed property broker registered with the Federal Motor Carrier Safety Administration (FMCSA). As a broker, we arrange the transportation of vehicles within the United States through licensed and insured motor carriers. Services may include open and enclosed transport, door-to-door and terminal shipping, and expedited shipping. The carrier assigned to your shipment is responsible for physically loading, transporting, and delivering your vehicle.

2. Quotes and Pricing

  • Quotes are estimates based on the information you provide, such as vehicle type, route, transport type, and timing.
  • The final price may change if the information provided is inaccurate or incomplete, for example if the vehicle is inoperable, modified, or larger than described.
  • Prices can be affected by fuel costs, season, route demand, and carrier availability. A quote is confirmed only once you have booked and we have sent you written confirmation.

3. Booking and Payment

  • Your booking is confirmed when we send you a written confirmation or order agreement.
  • Payment terms, including any deposit and the balance due at delivery, are stated in your order confirmation.
  • Payments are processed by third-party payment providers. You are responsible for any bank or card fees charged by your provider.
  • Late or failed payments may delay your shipment or lead to additional charges.

4. Your Responsibilities

To help your shipment go smoothly, you agree to:

  • Give accurate and complete information about yourself, the vehicle, and the pickup and delivery locations.
  • Make sure you are the owner or are authorized to ship the vehicle.
  • Remove all personal belongings, and do not ship hazardous or illegal items inside the vehicle. Personal items are generally not insured during transport.
  • Keep the fuel tank about one-quarter full or less, and disable any alarms or toll tags.
  • Make sure you or an authorized person (aged 18 or older) is available at pickup and delivery to inspect the vehicle and sign the paperwork.
  • Tell us about any mechanical issues, modifications, or leaks before pickup.

5. Pickup and Delivery

  • Pickup and delivery dates and times are estimates and are not guaranteed. Delays can happen because of weather, traffic, road closures, mechanical problems, or carrier scheduling.
  • Large trucks cannot always access residential streets. If the driver cannot reach your address safely, we may arrange to meet at a nearby location such as a large parking lot.
  • If no one is available at the agreed time, additional fees may apply, such as storage or redelivery charges.

6. Inspection and Bill of Lading

Before loading, the driver will inspect your vehicle and record its condition on a Bill of Lading (BOL). At delivery, you or your representative should inspect the vehicle carefully, compare it with the BOL, and note any new damage on the BOL before signing. Signing the BOL without noting damage may limit your ability to file a claim.

7. Insurance and Damage Claims

  • Carriers assigned to your shipment are required to carry cargo insurance. Coverage amounts and terms vary by carrier. You can ask us for the carrier’s insurance information.
  • Your personal auto insurance policy may also provide coverage. Check with your insurer.
  • If your vehicle is damaged in transit, note the damage on the BOL at delivery, take clear photos, and contact us as soon as possible and within couple days of delivery with your documents.
  • Insurance generally does not cover pre-existing damage, normal road wear, mechanical or electrical failures, personal items, or damage caused by acts beyond the carrier’s control.
  • We will help you submit your claim to the responsible carrier, but the carrier’s insurer makes the final coverage decision.

8. Cancellations and Refunds

  • You may cancel your booking by contacting us in writing.
  • If we cannot arrange transport for your vehicle, we will refund any amount you paid for services we did not provide.
  • Approved refunds are returned to the original payment method.

9. Limitation of Liability

To the fullest extent permitted by law, NexGen Auto Transport is not liable for indirect, incidental, special, or consequential damages, including loss of use, rental costs, lost income, or emotional distress, arising from delays or from the use of our website or services. Our total liability for any claim related to a shipment is limited to the amount you paid us for that shipment, except where the law does not allow this limitation. Nothing in these Terms limits any rights you have under applicable consumer protection laws or any claim you may have against the carrier’s cargo insurance.

10. Website Use and Intellectual Property

  • You agree to use our website only for lawful purposes and not to interfere with its operation, attempt unauthorized access, or submit false or misleading information.
  • All content on this website, including text, logos, graphics, and design, belongs to NexGen Auto Transport or its licensors and may not be copied or reused without our written permission.
  • Our website may link to third-party sites. We are not responsible for their content or practices.
  • Information on this website is provided for general purposes and does not guarantee specific prices, timelines, or results.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. We encourage you to contact us first so we can try to resolve any concern informally. If a dispute cannot be resolved, it will be handled in the courts located in Fort Bend County, Texas, unless the law requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Shipments already booked are governed by the Terms in effect when you booked. Continued use of our website after changes means you accept the updated Terms.
